The shipping conditions, delivery times, and return and withdrawal procedures are described in detail on the Shipping and Returns page, which is an integral part of these General Conditions.

2. Scope of application.

These General Conditions govern all sales contracts concluded through the Aelle Store online shop between Brignole and customers in the European Union countries served by the shop, listed on the Shipping and Returns page.

By placing an order on the site, the customer fully accepts these General Conditions in the version in force at the time of the order.

3. Registration, account, and site use

The customer can place orders as a guest or by creating an account; in any case, they are responsible for the accuracy and up-to-dateness of the data entered, such as address and contact details.

The customer is responsible for the confidentiality of their credentials and undertakes to promptly inform Brignole in case of unauthorized use of their account.

4. Offering, print-on-demand products and availability

The product descriptions, images, and prices on the site constitute an invitation to place an order and not a legally binding offer.

The products are made on a print-on-demand basis, i.e., to order, through third-party suppliers: each item is produced after receiving the order, so slight differences in color rendering or print placement compared to the illustrative images may occur. The legal warranty rights referred to in section 11 remain unaffected.

Exceptions are limited edition prints signed by the author, which are part of numbered and limited collections and are shipped directly by the authors or by authorized third parties; for these products, delivery times and methods are indicated on the product page and at the time of payment.

5. Prices, currencies and taxes

All prices are in euros and include VAT; the applicable rate depends on the destination country of the order, for example, 22 percent for Italy, in accordance with applicable tax regulations.

Shipping costs are indicated separately during the purchase process and are borne by the customer, except for free shipping for orders of €80 or more. Since the products are shipped from facilities located in the European Union to destinations within the European Union, no customs duties or import charges are due.

6. Conclusion of the contract

By submitting an order through the online shopping cart, the customer submits a binding offer to purchase the selected products.

The contract is considered concluded when the customer receives an order confirmation e-mail from Brignole at the indicated address; the confirmation includes the purchased products, applied prices, VAT, shipping costs, and any discounts.

7. Payment

Payment methods indicated at the time of payment are accepted, including in particular card payments via Stripe and installment payments with Klarna in countries where the service is available.

Brignole reserves the right to refuse a payment method, request advance payment, or cancel the order in case of suspected fraud or non-payment.

8. Shipping, delivery and promotions

1 Countries served. Delivery is limited to European Union countries, listed on the Shipping and Returns page. No shipments are made to Switzerland, the United Kingdom, or other non-EU countries.

2 Shipping cost. The shipping cost is determined at the time of payment based on the items ordered and the destination country, and is indicated to the customer before order confirmation. For orders where the product amount, after discounts, is €80 or more, shipping is free.

3 Delivery times. Products are made to order, so production time is added to transport time. Delivery normally occurs within 5 to 13 business days from order confirmation. Orders received after 2:00 PM Central European Time are processed on the next business day. The indicated times are estimates and not essential terms, unless otherwise agreed in writing.

4 Separate shipments. Products from different categories, particularly paper prints and clothing items, are packaged separately and may be delivered in distinct packages and at different times. In this case, multiple shipping costs apply to the order, calculated and indicated at the time of payment.

5 Address and non-collection. The customer is responsible for the accuracy and completeness of the delivery address. If the shipment is returned to the sender due to an incomplete or incorrect address, or due to non-collection, the cost of a new shipment is borne by the customer.

9. Risk transfer

The risk of loss or damage to the goods passes to the customer upon delivery to the customer or a person designated by them.

The customer is invited to inspect the goods upon delivery and to promptly report any transport damage to Brignole via e-mail, attaching photographic documentation. Failure to comply with this recommendation does not affect the consumer's legal warranty rights.

Returns, withdrawal, and incorrect or damaged products

1 Incorrect, damaged, or defective product. The customer has 14 days from receipt to report an incorrect, transport-damaged, or defective product by writing to store@brignole.ch and attaching photographic documentation of the product and packaging. Once the report is verified, the seller will provide a free replacement without requiring return. For undelivered shipments, the report must be made within 30 days of the estimated delivery date. This provision is in addition to and does not limit the legal conformity warranty referred to in section 11.

2 Right of withdrawal. The customer acting as a consumer and residing in a Member State of the European Union may withdraw from the contract within 14 days of receipt of the product, or of receipt of the last product in case of separate deliveries, without obligation to provide reasons and without penalty, pursuant to Directive 2011/83/EU and the corresponding national implementing provisions. Withdrawal is exercised by any explicit declaration sent to store@brignole.ch, also using the model form referred to in Annex I, Part B, of the Directive, published on the Shipping and Returns page.

3 Return and expenses. In case of withdrawal, the consumer returns the product within 14 days of the withdrawal notification to the seller's address, Via Monte Carmen 10, 6900 Lugano, Switzerland, indicated in the seller's reply. The direct costs of return, including those arising from the international nature of the shipment, are borne by the consumer, who is informed thereof pursuant to Article 49, paragraph 1, letter i), of the Italian Consumer Code and the corresponding provisions of other Member States. The seller reserves the right, in individual cases and at his sole discretion, to waive the return and proceed with the refund anyway.

4 Refund. The seller refunds all payments received, including standard delivery costs, within 14 days of receipt of the returned product or proof of its shipment, whichever is earlier, or from the communication by which the seller waives the return. The refund is made using the same means of payment used for the purchase and without any charge to the consumer. Additional costs resulting from the choice of a type of delivery other than the least expensive standard delivery offered by the seller are not refunded.

5 Decrease in value. The consumer is responsible for any decrease in the value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning, and the corresponding amount may be deducted from the refund in proportion.

6 Exclusions. The right of withdrawal does not apply to products made to measure or clearly personalized within the meaning of Article 16, letter c), of Directive 2011/83/EU, i.e. made based on text, image, measurement or data provided by the consumer. This circumstance is indicated in the product sheet before the order is concluded. The selection of size, color or format from the variants provided in the seller's catalog does not constitute personalization and does not exclude the right of withdrawal.

7 Exchanges. The seller does not carry out exchanges of size or product. The customer who wishes a different item exercises the right of withdrawal pursuant to section 10.2 and proceeds with a new purchase.

Legal guarantee of conformity

Consumers residing in a Member State of the European Union are covered by the legal guarantee of conformity provided for by Directive (EU) 2019/771 and the corresponding national implementing provisions, for a period of two years from the delivery of the goods.

In case of a lack of conformity, the consumer has the right, under the conditions of law, to restoration of conformity by repair or replacement, or to a price reduction or termination of the contract with refund.

For customers who do not act as consumers within the meaning of the aforementioned provisions, the rules of the Swiss Code of Obligations apply.

12. Liability

Brignole shall be fully liable for damages caused by willful misconduct or gross negligence, as well as for injury to life, limb, or health, in accordance with applicable legal provisions.

In case of slight negligence, Brignole's liability is limited to the typically foreseeable damage at the time of contract conclusion; indirect, consequential damages or loss of profit are excluded, to the extent permitted by law.

Any minor differences in color, positioning, or print quality, typical of print-on-demand production, do not constitute a product defect if they do not significantly compromise its intended use. The provisions of section 11 remain unaffected.

13. Intellectual property

Content, graphics, logos, texts, images, designs, and videos on the site are protected by copyright and other intellectual property rights; any unauthorized use, such as reproduction, distribution, or modification, is prohibited.

The purchase of products does not involve any transfer of rights on designs or graphic works, which remain the property of Brignole or the involved artists and designers.

14. Data Protection.

The customer's personal data are processed in compliance with the Swiss Federal Act on Data Protection and, for customers residing in the European Union, with the General Data Protection Regulation; details are provided in the site's Privacy Policy.

By using the site and completing an order, the customer acknowledges the processing of their data as described in the Privacy Policy, including transmission to service providers necessary for the execution of the contract, such as the e-commerce platform, payment systems, and production and logistics providers.

15. Account, security and misuse

The customer agrees not to use the site and payment systems unlawfully, fraudulently, or in violation of these General Conditions.

Brignole may suspend or cancel accounts and orders in case of misuse, non-payment, fraud, or attempts to manipulate promotions, prices, or security systems. Suspension does not affect rights already accrued by the customer on regularly concluded orders, including the right of withdrawal.

Platform and service providers

The online store is managed through the Ecwid e-commerce platform, which provides the technical infrastructure for the shopping cart, payment, and order management.

The production and shipping of print-on-demand products are entrusted to Printful, which operates from facilities located in the European Union.

Card payments are processed through Stripe; installment payments and other options offered by Klarna are available only in the expressly indicated countries, namely Austria, Belgium, Finland, France, Germany, Greece, Ireland, Italy, the Netherlands, Portugal, and Spain.

17. Links to third-party sites

The site may contain links to external sites, such as payment providers, social media, or partners; Brignole has no control over such sites and is not responsible for their content or practices.

Access to third-party sites is at the customer's own risk, and the customer is required to consult their respective terms and conditions and privacy policies.

Changes to general conditions

Brignole may modify these General Conditions; the updated version will be published on the site and will apply only to orders placed after publication. The version in effect at the time of the order will apply to orders already concluded.

In case of substantial changes, registered customers may be informed via email or through a notice on the site.

Complaints, applicable law, and competent court

1 Complaints. Any complaint can be sent to store@brignole.ch; the seller will respond within two business days. The seller does not participate in alternative dispute resolution bodies. Consumers residing in the European Union who wish to receive free assistance in a dispute with a foreign seller can contact the European Consumer Centre in their country.

2 Applicable law. These General Conditions and the contractual relationships between Brignole and customers are subject to Swiss substantive law, excluding the rules on conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods. For consumers residing in the European Union, the mandatory consumer protection provisions of their country of residence remain applicable and prevail over these General Conditions in case of conflict.

3 Competent court. For customers not acting as consumers, the exclusive jurisdiction is Lugano, Switzerland. A consumer residing in a European Union member state may bring an action, at their option, before the court of their domicile or before the court of the seller's registered office, and the seller may bring an action against them only before the court of the consumer's domicile, in accordance with Article 18 of Regulation (EU) 1215/2012 and Article 16 of the Lugano Convention of October 30, 2007.

20. Final clauses

The invalidity or unenforceability of any provision of these General Conditions does not affect the validity of the remaining provisions; the invalid clause will be replaced by a valid provision that comes as close as possible to the original economic purpose, in compliance with mandatory consumer protection rules.

The failure, even repeated, by Brignole to exercise a right does not constitute a waiver of its future exercise.
